lyricpulse.cloud (“we,” “our,” or “us”) operates the website located at lyricpulse.cloud (the “Service”). We take the intellectual property rights of others seriously and require that our users do the same. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law.

This page constitutes our formal policy for managing allegations of copyright infringement in accordance with 17 U.S.C. § 512 and the Digital Millennium Copyright Act (“DMCA”).

1. Designation of Copyright Agent

We have designated a Copyright Agent to receive notifications of claimed copyright infringement. If you believe your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the written information specified below.

2. Filing a DMCA Notice of Alleged Infringement

If you are a copyright owner or an agent thereof and believe that any content on the Service infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (preferably a direct URL to the lyrics or content).
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. Good Faith Belief Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (e.g., consider whether the use is Fair Use).
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.

3. Procedure Upon Receipt of a Valid DMCA Notice

Upon receipt of a valid and complete notice as described above, lyricpulse.cloud will take the following steps:

  • We will expeditiously remove or disable access to the material that is alleged to be infringing.
  • We will take reasonable steps to notify the user who posted the material (the “Alleged Infringer”) that we have removed or disabled access to the material.
  • We will provide the Alleged Infringer with a copy of the DMCA Notice (excluding private contact information where appropriate).

4. Liability for Misrepresentation (Section 512(f))

Please be aware that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys’ fees incurred by us or our users, if you knowingly materially misrepresent that material or activity is infringing. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.

5. Filing a Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Copyright Agent:

  1. Your Signature: Your physical or electronic signature.
  2. Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Contact Information & Jurisdiction: Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if your address is outside of the United States), and that you will accept service of process from the person who provided the original notification of alleged infringement.

6. Procedure Upon Receipt of a Counter-Notification

If a Counter-Notice is received by our Copyright Agent, we may send a copy of the Counter-Notice to the original complaining party informing that person that we may replace the removed content or cease disabling it in 10 business days.

Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, lyricpulse.cloud has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We define a “repeat infringer” as any user who has received two or more DMCA takedown notices. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

8. Standard Technical Measures

We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works. We do not support or condone the circumvention of encryption or other security features.

9. Non-Legal Advice

The information contained in this DMCA Policy is for informational purposes only and does not constitute legal advice. If you have questions about your rights or obligations under the DMCA or copyright laws, you should consult with a qualified attorney.

10. Modifications to Policy

We reserve the right to modify, alter, or update this policy at any time. Such modifications shall become effective immediately upon posting. Your continued use of the Service constitutes your acknowledgment and acceptance of such modifications.
